Terms of Service

These terms are an agreement between you and Kennedi Avelino ("we", "us"), Mount Wellington, Auckland 1060, New Zealand, about Xakto: the Chrome extension, the xakto.app website and docs, and the relay program xakto-mcp. By installing or using Xakto, you agree to them. If you use Xakto for an organisation, you agree for it too, and confirm you may.

1. What Xakto is

Xakto is a browser extension for inspecting, editing, cloning and checking web pages in your own browser. It has a free plan and paid plans, described on our pricing page.

2. Plans

  • Free costs nothing and needs no account. It includes the features and monthly allowances the pricing page lists. We may change what Free includes.
  • Pro is a monthly or yearly subscription, as you choose. It renews automatically at the end of each month or year until you cancel.
  • Lifetime is a single payment for Pro, including every 1.x version of Xakto for as long as we offer it, and version 2 at half price. It is sold for a limited time, as the pricing page says.
  • Team and company plans, when offered, are described when they launch, and may come with additional terms.

We won't take away a paid feature during a period you've already paid for. If we make a significant change to Pro, you can cancel and ask for a pro-rated refund of the unused time.

3. Buying Xakto

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

  • Prices are shown at checkout, with any tax your country requires.
  • Renewal: Pro renews at the same price. A founding price stays your price for as long as your subscription continues without a break. Any other price change applies only from a renewal at least 30 days after we tell you.
  • Cancelling: you can cancel at any time from the link in your Paddle receipt, at paddle.net, or by writing to [email protected]. Pro stays on until the end of the period you paid for, and is not renewed.
  • Refunds: see our Refund Policy.

4. Your account

You need an account only for a paid plan. Keep access to its email address secure: signing in sends a one-time code there.

  • An account is for one person, and may be used in up to three browsers at once, shown in Xakto's Settings › Plan. For several people, buy a seat for each.
  • You're responsible for what happens under your account. Tell us at once if you think someone else is using it.
  • You can ask us to delete your account at any time by writing to [email protected]. Deleting it ends any paid plan without a refund, except as our Refund Policy allows.

5. Your licence to use Xakto

We give you a personal, non-exclusive, non-transferable licence to use Xakto under these terms. You may not:

  • sell, rent, share or sublicense Xakto, a paid plan or an account;
  • get round the free plan's allowances, the browser limit, or how Xakto checks a paid plan;
  • copy, modify or redistribute Xakto's code, except as the law allows you to despite this term, or as an open-source licence that comes with part of Xakto allows;
  • use Xakto to break the law, to break a website's terms, to gain access you aren't allowed, or to disrupt a website or our services.

Xakto includes open-source components, each under its own licence, which we list with Xakto. Nothing in these terms limits your rights under those licences.

6. The pages you use Xakto on

Xakto works on pages other people own. You are responsible for having the right to do what you do with them.

  • Clones, exports and copied styles may contain other people's text, images, code, trademarks and fonts. Using them is between you and their owners. Fonts in particular are licensed: you need a licence wherever you ship them.
  • Site scans read a site's own pages, its sitemap and robots.txt, and skip what robots.txt rules out. Don't use them on sites whose terms forbid it.
  • Edits made with Xakto change only your own browser's copy of a page, until you apply them to source code you control.

7. Your content

What you make with Xakto is yours: edits, annotations, findings, reports and exports. On the free and paid plans it stays on your computer, as our Privacy Policy describes. We store only what your account needs. When team features launch, shared content will be covered by these terms as updated then.

8. Coding agents

The relay xakto-mcp runs on your own computer and connects Xakto to a coding agent you choose. What your agent sends to its own model provider is governed by that provider's terms, not ours. Changes an agent makes to a page through Xakto are made on your behalf.

9. The usability and accessibility check

The check is automated. It finds signs of problems against WCAG 2.2 and Nielsen's heuristics; it can't certify that a page conforms to WCAG or meets any accessibility law. Treat its results as a starting point for review by a person.

10. Changes and availability

We update Xakto from time to time, and may change or stop features. Paid features keep working offline for a limited time, as Settings › Plan shows. We don't promise Xakto will be available without interruption or free of errors.

11. Disclaimers

Xakto is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, including that Xakto is fit for a particular purpose. If you are a consumer, you have legal rights that these terms cannot remove, and nothing in them affects those rights.

12. Limit of liability

To the extent the law allows, we are not liable for indirect or consequential losses, or for lost profits, revenue or data. Our total liability to you for any claim is limited to what you paid us in the 12 months before it arose. These limits don't apply where the law doesn't allow them, such as liability for death or personal injury caused by negligence, or for fraud.

13. Ending this agreement

You can stop using Xakto at any time by removing it. We may suspend or end your access if you seriously or repeatedly break these terms; where we can, we'll tell you first and give you a chance to put it right. Sections 6, 7, 11, 12 and 14 continue after this agreement ends.

14. Governing law

These terms are governed by the laws of New Zealand, and the courts of New Zealand have jurisdiction. If you are a consumer, you keep the protection of the laws of the country you live in, and can bring a claim there.

15. Changes to these terms

We may change these terms. If a change matters, we'll tell account holders by email and post it on this page at least 30 days before it takes effect. If you don't agree, you can stop using Xakto and cancel; using it after the change means you accept it.
